NDAA Section 1286 List: “Foreign Institutions Engaging in Problematic Activities”

The NDAA 1286 List identifies individuals, companies, and institutions that the U.S. Government has flagged as a concern to national security. The 1286 List specifically counters unwanted foreign influence on Department of War funded research by listing foreign entities and talent programs confirmed to be engaging in activities that threaten U.S. national security interests.

Effective FY 2026, the Department is prohibited from using any funds for fundamental research that involves collaboration with any entity on the most recent Section 1286 list. This prohibition on obligating or expending funds applies to grants, contracts or any other assistance to institutions of higher education. The restriction forbids conducting research in collaboration with, or using equipment from, any listed entity. This funding prohibition extends to all employees of such institutions.

Researchers are warned that collaborating with an individual affiliated with an entity on the 1286 List constitutes a compliance risk and may negatively impact their eligibility for federal funding. Researchers are required to disclose all affiliations with these entities and any activities related to foreign talent recruitment programs. Failure to fully report this information is a serious matter and may violate federal law.
